- I talked to a prominent lawyer about this, and heres what he told me.
- In order to sue successfully for defemation, you have to:
1} Prove you have a celebrity to lose, or some tangible lose of any worth.
2) Prove the statements were innaccurate AND done with malice aforethought.
- If those weren’t hills enough, all the defense would need to do is ask for a summary dismissal on the grounds that whatever possible offense occured, if any, Imus was punished far in excess of the crime when he lost a 40 million dollar job. No sane judge would find against him at that point.
- They dropped it because they would just end up losing, and they can’t mine it for any more race baiting PR. It wasn’t sanity, it was realism.
- Al sharpton isn’t going to be happy about this. One of the ambulances he was chasing has turned up with four flat tires.
